Rape Report Leads to Arrest — Should Sexual Assault Victims Be Taken to Jail When They Come Forward?

A troubling case reported at Frank N Steins Bar is raising a difficult question for the community: What happens when a sexual assault victim has an outstanding warrant? 

Portsmouth Police say a woman contacted them to report she had been sexually assaulted at the bar. 

Officers responded and took the allegation seriously. The woman was transported to a hospital where a sexual assault forensic examination was conducted, and police secured the evidence connected to the case. 

But the situation took an unexpected turn afterward. 

Police discovered the woman had an active warrant, and under Ohio law officers are generally required to act on warrants when they encounter someone listed in the system. As a result, she was arrested and booked into the Scioto County Jail. 

The Question Many People Ask 

Cases like this raise a difficult issue for law enforcement and victims’ advocates alike: 

Is it right to arrest someone who has just come forward to report a sexual assault? 

Supporters of strict enforcement say police don’t have the discretion to ignore warrants once they discover them. Failing to act on a warrant can create legal problems for officers and their departments. 

But victim advocates warn that situations like this can create a chilling effect — making victims afraid that if they report an assault, they might end up in handcuffs themselves.
