The Scioto County Fairgrounds is currently under investigation for allegedly engaging in unlicensed alcohol sales during two recent events. In both instances, beer was reportedly made available to attendees, including a private function and an event open to the public.
Pictures that surfaced on social media clearly show alcohol being advertised and consumed.
We told you about the Scioto County Commissioners discussing the possibility of alcohol sales several months ago. During that meeting, Commissioner Cathy Coleman said this does not mean alcohol would be sold at the fair. “This is for special events only. There would be strict conditions to make sure the sales are overseen by authorities.” The commissioners decided they needed a more detailed proposal before making any decision.
The Ohio Revised Code laws explicitly outline the regulations for the sale and distribution of alcohol, and it is mandatory for establishments to adhere to these guidelines. As per the Ohio Revised Code Section 4301, it is unlawful to sell or offer for sale any alcoholic beverages without a proper permit.
In light of these allegations, the Scioto County Daily News (SCDN) conducted an extensive review, examining every liquor license ever issued in Scioto County dating back to the 1970s. No version of the Scioto County Agricultural Society or Scioto County Fairgrounds was found on the list, indicating a potential lack of proper licensing.
Engaging in the sale of alcohol without the required permits can have serious consequences. As stipulated in the Ohio Revised Code. Section 4301, violators may face penalties, including fines, imprisonment, or both, depending on the circumstances and the severity of the offense.
SCDN issued a formal request under the Ohio Open Records Act to the Fair Board for relevant documentation regarding their compliance with alcohol sales regulations. Unfortunately, the deadline for responding to the request was ignored. The Fair Board is responsible for all fairground operations, and this needs to be clearly stated.
