One-day child porn sentenced overturned for Ohio man
What many would consider a ridiculously light sentence for possessing child porn has been overturned thanks to an appeal by the U.S. Attorney’s Office.

During his sentencing hearing, his defense claimed that his child pornography obsession came from combat trauma and PTSD related to his service in the military in Iraq. Demma was sentenced to what amounted to one day in jail by Judge Walter Rice. Demma was also ordered to pay $5000 each to the nine victims who could be identified.
The U.S. Attorney’s Office appealed, claiming that the sentence was unreasonably low under the circumstances.
The court agreed, pointing out both Demma’s extensive collection of disturbing images and the fact “that there is no evidence in the record to support the proposition that military veterans suffering from PTSD typically become addicted to child pornography.”
Demma’s sentence has been vacated and he’ll have to go back to court to be resentenced.
No date has been set for that sentencing.
