Horton Case Returns to Court Amid Plea Deal Questions

Horton case returns to court

After months of uncertainty, there’s finally a new date on the calendar in Robert Horton’s public corruption case. And with Bryan Davis now in prison, charges against Horton’s wife potentially headed for dismissal, and questions about a possible deal to keep Horton out of prison, the upcoming hearing could be particularly interesting.

Former Scioto County Commissioner Bryan Davis is already behind bars. Prosecutors have asked to drop the charges against Robert Horton’s wife. And now Horton himself is headed back to court, with one big question still unanswered.

Did the former county economic development director make a deal that could keep him out of prison?

Horton is scheduled for a criminal pretrial hearing at 9:30 a.m. Thursday, November 12, in Scioto County Common Pleas Court.

The hearing comes nearly two years after Horton was indicted in the public corruption investigation involving the Southern Ohio Port Authority, the SOAR Business Park and former Commissioner Bryan Davis.

And while Davis is serving a 30-month prison sentence, his own attorneys have claimed Horton reached an agreement with prosecutors that could result in a very different outcome.

Did Horton Make a Deal?

One of the most intriguing developments in the case didn’t come from Horton’s attorneys. It came from Bryan Davis’s defense team.

Before Davis was sentenced in September, his attorneys submitted a memorandum asking the judge to impose community control instead of prison.

As part of their argument, they claimed Robert Horton had entered into a cooperation agreement with the State of Ohio.

According to that filing, prosecutors had agreed to recommend community control for Horton in exchange for his cooperation.

Community control is essentially probation. It allows a convicted person to remain outside prison while following conditions imposed by the court.

Davis’s attorneys pointed to the reported arrangement while arguing that their client should receive similar consideration.

But there’s a catch.

The claim appeared in Davis’s sentencing memorandum, not in a publicly confirmed plea agreement or sentencing order for Horton.

And even if prosecutors have agreed to recommend probation, the judge would not necessarily be required to follow that recommendation.

That leaves two important questions: Has Horton actually reached an agreement with the state, and will the judge accept it?

The November 12 hearing could provide some answers.

Prosecutors Want Charges Against Horton’s Wife Dropped

Another major development came in September, when Special Prosecutor Samuel J. Kirk III filed a motion asking the court to dismiss all charges against Horton’s wife, Lioubov.

She originally faced 12 felony counts in connection with the alleged corruption scheme.

But after conducting additional interviews and reviewing more evidence, prosecutors said they no longer believed they could establish that she had the knowledge necessary to be held criminally responsible.

In the September 18 motion, the state said Lioubov Horton had been acting under someone else’s direction and did not sufficiently understand the financial transactions involved.

Prosecutors asked that the charges be dismissed without prejudice, meaning the state could potentially bring charges again if legally permitted.

As of SCDN’s last review of the court docket, no ruling on that motion had been posted.

The motion is particularly interesting because prosecutors acknowledged conducting additional interviews with both Robert and Lioubov Horton.

Whether those interviews are connected to the cooperation agreement described by Davis’s attorneys remains unknown.

Bryan Davis Is Already in Prison

The contrast with Bryan Davis’s case is striking.

Davis pleaded guilty in July to three felony charges: theft in office, receiving stolen property and filing an incomplete, false or fraudulent tax return.

In September, Visiting Judge D. Dean Evans sentenced him to 30 months in prison.

Davis was also ordered to pay $67,808.67 in restitution to Scioto County, along with other financial penalties.

He entered the Ohio prison system in October and has since been transferred to Belmont Correctional Institution near St. Clairsville.

His attorneys had asked for community control, but the judge rejected that request.

Davis’s wife, Lorinda “Lori” Davis, received a different sentence.

She pleaded guilty to tampering with evidence and was sentenced to two years of community control rather than prison.

That means the four defendants originally tied to the corruption investigation are now facing very different circumstances.

One is in prison. Another is on probation. Prosecutors want to drop the charges against a third.

And the fourth, Robert Horton, still has an unresolved criminal case.

What Is Horton Accused Of?

Horton formerly served as Scioto County’s economic development director and headed the Southern Ohio Port Authority.

He was indicted in February 2025 on 15 felony counts, including engaging in a pattern of corrupt activity, theft in office, aggravated theft, bribery, money laundering, tampering with public records and having an unlawful interest in a public contract.

Investigators alleged that Horton used his position to help arrange public construction contracts and received illegal payments disguised as legitimate business commissions.

The investigation centered partly on a steel building project at the SOAR Business Park near the Greater Portsmouth Regional Airport.

Prosecutors alleged that payments were routed through a consulting company owned by Horton’s wife.

Horton has not been convicted of those charges, and the allegations remain unproven unless established through a guilty plea or trial.

The case was originally scheduled for trial in July 2025, but that trial was postponed. A series of status conferences followed without a final resolution.

Will November 12 Finally Bring Answers?

A pretrial hearing doesn’t necessarily mean a plea agreement or trial date will be announced.

The court could address pending motions, discuss the status of negotiations, schedule additional proceedings or take other steps toward resolving the case.

But the timing makes this hearing especially noteworthy.

Bryan Davis has already been sentenced and transferred to prison. His wife has received probation. Prosecutors have publicly explained why they want to dismiss the case against Lioubov Horton.

That leaves Robert Horton, the former economic development official whose alleged conduct was central to the original investigation.

If the cooperation agreement described by Davis’s attorneys exists, the public has yet to see how it will affect Horton’s case.

And if prosecutors are prepared to recommend that Horton avoid prison, the next question is whether the court will agree.

For now, the mystery isn’t what happened to Bryan Davis. It’s what will happen to Robert Horton.

The next opportunity for answers is November 12 at 9:30 a.m. in Scioto County Common Pleas Court.
