FAMILY CLAIMS FUNERAL HOME IS “HOLDING REMAINS HOSTAGE” OVER BILL DISPUTE

family says funeral home held remains hostage
ShareTweetEmail

A Portsmouth-area woman contacted police claiming a funeral home is refusing to release a loved one’s remains until an ongoing payment dispute is resolved.

According to the report, the woman wanted to follow up on a complaint she previously filed involving alleged record issues connected to funeral arrangements.

The caller told police the funeral home was holding the deceased’s remains because of an unpaid bill.

Police reviewed paperwork the woman provided, including funeral service documents issued earlier this month and a signed contract agreeing to pay funeral expenses.

According to the report, updated billing paperwork was later issued under a different family member’s name.

The family claims the funeral home is refusing to proceed until the issue is settled through probate court.

⚖️ HOW FUNERAL COSTS AND ESTATES WORK IN OHIO

Situations like this are emotionally devastating—but unfortunately not uncommon after someone dies.

In Ohio, funeral expenses are generally considered debts of the deceased’s estate.

However, problems can arise when:

  • Family members sign contracts personally
  • Multiple relatives are involved
  • There are disputes over who is financially responsible
  • Or the deceased had little or no money available

👀 CAN A FUNERAL HOME REFUSE TO RELEASE REMAINS?

Funeral homes do have legal rights involving unpaid services and contracts.

If someone signs paperwork accepting responsibility for funeral costs, the funeral home may attempt to collect payment from:

  • The estate
  • Insurance proceeds
  • Or the person who signed the agreement

Disputes sometimes end up in probate court, especially when:

  • Bills are disputed
  • Estates are unresolved
  • Or family members disagree about responsibility

⚠️ WHY THESE CASES BECOME SO EMOTIONAL

Arguments involving funeral arrangements often happen during one of the worst moments in a family’s life.

People are grieving while also dealing with:

  • Contracts
  • Insurance paperwork
  • Probate issues
  • Unexpected expenses
  • Family disagreements

And funeral costs can quickly reach thousands of dollars.

📋 WHAT FAMILIES CAN DO

Please Support This Local Business

Experts recommend families:

  • Read funeral contracts carefully before signing
  • Clarify who is legally responsible for payment
  • Ask for written itemized pricing
  • Speak with probate attorneys if disputes arise
  • Keep copies of all paperwork and communications

Because once documents are signed, disagreements over funeral expenses can quickly become legal disputes—not just family arguments.
