What a Family Law Attorney Handles Beyond Just Divorce

Divorce is the type of case that brings most clients into a family law office for the first time. But it is far from the only matter handled there. Custody fights between unmarried parents, child support enforcement, paternity disputes, adoption proceedings, and prenuptial agreements all fall under family law. Each one has its own rules, court procedures, and deadlines.

A family law attorney in Concord NC can represent you in any of them. Some of these matters are time-sensitive in ways that are not obvious until the deadline has already passed, and the consequences of missing one can be permanent.

Custody Outside of Divorce

You do not need to be married, separated, or divorced to end up in a custody dispute. Unmarried parents file custody actions. Grandparents petition for visitation. A parent who has had no contact for years may file for access. All of these go through family court.

The court evaluates custody using the “best interests of the child” standard. What that means in practice depends on the facts. The judge looks at each parent’s living situation, their relationship with the child, whether there is a history of domestic violence or substance abuse, and, if the child is old enough, what the child wants.

Changing an existing custody order is more difficult than getting one in the first place. You have to show that something has changed materially since the order was entered. A parent moving out of state qualifies. A vague claim that the current arrangement is not working usually does not.

Child Support

Both parents’ incomes, the number of children, and the custody split are factored in to calculate the monthly amount for child support. The formula varies by state.

Enforcement and modification are where things get complicated. If the paying parent loses a job or takes a significant pay cut, they can petition to have the amount reduced. But the reduction only applies from the date the petition is filed. Back payments owed before that date do not get adjusted. Every month between the job loss and the filing is a month of support calculated at the old rate.

On the enforcement side, unpaid child support can lead to wage garnishment, seizure of tax refunds, license suspensions, and contempt charges.

Paternity

If paternity has not been legally established, the father has no custody or visitation rights. The mother cannot pursue a child support order. The child has no legal claim to the father’s insurance, inheritance, or medical history.

Paternity can be established voluntarily through a signed acknowledgment, or through a court petition that may involve genetic testing. Once established, the court can enter orders for custody, visitation, and support.

Challenging paternity after it has been legally established is difficult. Most states impose strict time limits. If there is a question about paternity, raising it before signing anything or before a default order is entered is critical, because the window to contest it will close.

Adoption

Adoption proceedings require court approval regardless of the circumstances. The legal process includes background checks, home studies, and either the biological parent’s consent or the termination of their rights.

Stepparent adoptions are the simplest version of this, but they still require a court proceeding. If the biological parent whose rights would be terminated does not consent, the case becomes contested, and contested adoptions take longer and cost more.

Prenuptial and Postnuptial Agreements

A prenuptial agreement is a contract signed before the wedding that sets terms for asset division and spousal support in the event of a divorce. A postnuptial agreement does the same thing but is executed after the marriage has already taken place.

Courts will enforce these agreements, but only if the process was clean. Both parties must fully disclose their financial situation. Both need to have had the chance to consult their attorneys. The terms cannot be so one-sided that a court would consider them unconscionable. An agreement signed the night before a wedding by someone who never saw a lawyer is not going to hold up.

Filing Deadlines and Timing

If you file a child support modification petition three months after a job loss, you will not get back that overpayment. If you are dealing with any of these issues and wait too long, you can lose rights and money that no court order can restore.
